Not 9(b), at least right now. The case was filed in California state court and there is no complete diversity because one of the named defendants is a California citizen (as is Bunsow); Bunsow also sued a bunch of Doe partners, some of whom theoretically could be California citizens. So there is no way to remove the case.

Anyone know what California's pleading rules are?
