CFP: Jaharis Health Law Symposium

The DePaul Journal of Health Care Law, Mary and Michael Jaharis Health Law Institute, and Center for Intellectual Property Law & Information Technology (CIPLIT®) are excited to announce a Call for Papers in connection with the 2022 Jaharis Health Law Symposium.

This year’s topic, “Antitrust and Access to Care: Lessons from Market Consolidation and a Public Health Crisis,” will explore how consolidation across health care markets has impacted access to care. Prominent legal scholars, antitrust enforcers and expert practitioners will address a range of questions through four separate panels focusing on health insurance, pharmaceutical, hospital and digital health markets.

Three papers will be selected from the submissions. Each selected author will receive a $500 honorarium and their article (of approximately 10,000 words) will be published in the Symposium issue of the DePaul Journal of Health Care Law. Full article drafts will be due by June 1, 2022.

We are open to a wide range of topics consistent with the Symposium theme but are particularly interested in papers from scholars with diverse experiences and backgrounds researching health insurance or pharmaceutical markets, as well as papers from junior scholars.

The Symposium will be held both in-person and remotely at DePaul College of Law in Chicago on March 10, 2022. Presenters able to appear in person will receive reimbursement for reasonable travel expenses.

Please submit an abstract of no more than 500 words to [email protected] by January 15, 2022, with the subject line “Jaharis Symposium: Call for Papers.” You also may submit an optional statement of no more than 500 words describing how your selection would enhance the diversity of the Symposium.

Risk Regulation Slides Are Posted

As I mentioned in an earlier post, the OECD Regulatory Policy Division, together with the International Risk Governance Council (IRGC) and the Rethinking Regulation program at Duke University recently held a conference on Improving Risk Regulation: From Crisis Response To Learning and Innovation at the OECD Conference Centre in Paris.  All of the slides from the conference, including mine, have now been posted online, and some of you may find some of the presentations useful. 

From the IRCG conference website:

New approaches to regulation may be stimulated by careful research and practical experience, but also spurred by crisis events that alter perceptions and spark demand for policy change.  What can we learn from these diverse sources of regulatory change? How can we do a better job in fostering constructive regulatory improvement?

The conference identified, evaluated and discussed the relevance and effectiveness of new approaches to improving risk governance, both as they result from responding to and learning from crises, and as deliberate innovations in how regulatory power is exercised and shared.  It built upon: 

• Work from the OECD Regulatory Policy Division about “Risk and Regulatory Policy – Improving the Governance of Risk” and recommendation about performance- and consumer-based regulation
• The project on “Recalibrating Risk: Crises, Perceptions and Regulatory Change,” of the Rethinking Regulation program at Duke University, which investigates how regulatory policies and institutions change in response to crisis events, and seeks lessons for the future
• IRGC’s work on the role of regulatory frameworks and institutional arrangements in the context of risk governance, including mechanisms for adaptive regulation that are able to update in response to new information and contexts.

The conference brought together practitioners of risk governance and regulation from private, public and academic organizations interested in sharing knowledge and enhancing their understanding of crisis and new forms of risk regulation.

The Thirteenth Amendment through the Lens of Class and Labor CFP

Cribbing now from a call for papers for a conference on the Thirteenth Amendment that will be held in Seattle next year:

Approaching the 150th anniversary of the Thirteenth Amendment, we find ourselves in a period of heightened concern about issues of economic inequality. If any provision of the United States Constitution speaks to those issues, it is the Thirteenth Amendment. The Amendment’s proponents maintained that it established “freedom” and a “free labor system,” a view eventually accepted by the U.S. Supreme Court. Beginning after the turn of the millennium, Congress has drawn on the Amendment to support legislation outlawing the “new slavery,” including – for the first time – forms of labor control other than physical force or legal compulsion. Conversely, state governments have cited
the Amendment’s punishment clause to justify forced labor by prisoners in a rapidly growing archipelago of private prisons and prison industries.

Paper proposals should focus on the Thirteenth Amendment and include class or labor as an important theme. Proposals addressing the relations (including relative priorities) and intersections of race, gender, and sexual orientation with class or labor are strongly encouraged. Proposals should be e-mailed to [email protected] by January 10, 2015. We anticipate that the papers will be published in a law review symposium issue.

The State and The Market

 

The intersection of the state and the market is the center of attention of many theoretical perspectives and disciplines.  The ways in which states design their markets and set their borders has a major effect on the nature of society, and the identities of individuals within it. At the same time markets (in goods, in services, investments as well as the market-like competition between states under globalization) alter states’ policies and capabilities and curtail their sovereign powers.

In this workshop, we wish to encourage participants to present their work in progress focusing on the description, explanation, and the normative evaluation of the mutual effects of states and markets: the cases where the two institutions limit one another and the cases where they facilitate each other’s prosperity.

Selling The Starred Footnote

I’m late to the game in blogging about this, but I just found out about it on Friday at a conference on the Ethical Limits of Markets hosted by the Institute For The Study of Markets and Ethics at Georgetown University’s McDonough School of Business (about which I’ll have more to say later).  Jason Brennan and Peter Jaworski are selling acknowledgements in the preface of their book Markets without Limits, which will be published by Routledge Press, most likely in late 2015 or early 2016.

The book answers the question “Are there some things which you permissibly may possess, use, and give away, but which are wrong to buy and sell?” in the negative, in contrast to the numerous books already written on the topic which take the contrary position.  Brennan and Jaworski are selling three tiers of acknowledgements: Silvermint Tier, Platinum Tier, and Gold Tier (The Silvermint Tier is so named because philosophy and women’s studies professor Daniel Silvermint is paying to have the highest tier named after him.)

Wish I had thought of that!  But no reason I can’t adopt it going forward.  In addition, I’ve decided to sell links to and mentions of your work in my blog posts and tweets.  I’m still working out the exact fee schedule, but will charge extra for highly positive mentions and even more for highly negative mentions (as controversy is always an attention getter). Finally, if those pesky law review editors won’t stop bothering you for support that you can’t find, just let me know and I’ll sell you a blog post setting out the needed statements, to which you can then cite. 

We often complain that student editors demand support for obviously correct statements of common knowledge – indeed, it is sometimes the case that the proposition is so widely known and accepted that it is difficult to find discussion of the point in print.  For example, you may want to reference the uncontroversial view that “professors of market regulation are considered smarter and more interesting than professors of constitutional law,” yet struggle to find something in print to that effect (in contrast to the faculty lounge and hallway conversations in which this assertion is frequently found). Problem solved!  Just let me know the statements for which you need a citation and I’ll post them here for a fee.  The profit possibilities on this one are nearly endless. 

Conference on Digital Experimentation (CODE) at MIT Sloan

Another stop on my fall Facebook/OKCupid tour: on October 10, I'll be participating on a panel (previewed in the NYT here) on "Experimentation and Ethical Practice," along with Harvard Law's Jonathan Zittrain, Google chief economist Hal Varian, my fellow PersonalGenomes.org board member and start-up investor Ester Dyson, and my friend and Maryland Law prof Leslie Meltzer Henry.

The panel will be moderated by Sinan Aral of the MIT Sloan School of Management, who is also one of the organizers of a two-day Conference on Digital Experimentation of which the panel is a part. The conference, which brings together academic researchers and data scientists from Google, Microsoft, and, yes, Facebook, may be of interest to some of our social scientist readers. (I'm told registration space is very limited, so "act soon," as they say.) From the conference website:

The ability to rapidly deploy micro-level randomized experiments at population scale is, in our view, one of the most significant innovations in modern social science. As more and more social interactions, behaviors, decisions, opinions and transactions are digitized and mediated by online platforms, we can quickly answer nuanced causal questions about the role of social behavior in population-level outcomes such as health, voting, political mobilization, consumer demand, information sharing, product rating and opinion aggregation. When appropriately theorized and rigorously applied, randomized experiments are the gold standard of causal inference and a cornerstone of effective policy. But the scale and complexity of these experiments also create scientific and statistical challenges for design and inference. The purpose of the Conference on Digital Experimentation at MIT (CODE) is to bring together leading researchers conducting and analyzing large scale randomized experiments in digitally mediated social and economic environments, in various scientific disciplines including economics, computer science and sociology, in order to lay the foundation for ongoing relationships and to build a lasting multidisciplinary research community.

Fall Facebook/OKCupid & the Future of Research Tour

I’m participating in several public events this fall pertaining to research ethics and regulation, most of them arising out of my recent work (in Wired and in Nature and elsewhere) on how to think about corporations conducting behavioral testing (in collaboration with academic researchers or not) on users and their online environments (think the recent Facebook and OKCupid experiments). These issues raise legal and ethical questions at the intersection of research, business, informational privacy, and innovation policy, and the mix of speakers in most of these events reflect that.

The first, and most accessible, is a “tweet chat” today, from 1-2 p.m. EST, on “Research Ethics in a Modern World.” It’s being sponsored by the Milken Institute’s FasterCures, “an action tank driven by a singular goal — to save lives by speeding up and improving the medical research system.” Other participants are Susannah Fox (RWJF's first Entrepreneur in Residence), John Wilbanks (a very interesting guy whose work, largely on empowering patients and research participants to share their data in ways that are consistent with their values, and bio defy concise description), and Margaret Anderson (FasterCures’s Executive Director).

Likely discussion topics include the impact of social media on research and research ethics; the ethics of A/B testing and similar behavioral testing of user environments (i.e., websites) by corporations, and who should be empowered to conduct research risk-benefit analysis (patients/participants? scientists? legal systems?). You don’t need to have a Twitter account to read the conversation, either as it unfolds in real time or at any time thereafter. Just point your web browser to this URL. But to ask a question or otherwise participate in the discussion (which is encouraged!), you do need a Twitter account.

On October 22, I’ll be at Harvard Law participating in a panel discussion of the Petrie-Flom Center’s latest anthology, “Human Subjects Research Regulation: Perspectives on the Future,” with Glenn Cohen, Holly Fernandez Lynch, and Barbara Bierer.

On December 4, I’ll be at Colorado Law participating in a day-long conference, “When Companies Study Their Customers: The Changing Face of Science, Research, and Ethics,” sponsored by the Silicon Flatirons Center for Law, Technology, and Entrepreneurship and the Tech Policy Lab at the University of Washington. Other participants include law profs Paul Ohm, Ryan Calo, and James Grimmelman, Princeton Center for Internet Technology Policy Director Edward Felten, FTC Commissioner Julie Brill, and UT-Austin psychologist Tal Yarkoni.

On December 5, I’ll be in Baltimore participating in a Meet the Authors lunch event at the annual PRIM&R conference with the editors and several other contributors to the aforementioned book.

And on December 6, I’ll be participating in a PRIM&R session on “Manipulating Emotions on the Internet: The Cases of Facebook, OkCupid,” with OHRP Director Jerry Menikoff, privacy and Internet research ethics scholar Michael Zimmer, and Berkeley Director of Research Subject Protection Rebecca Armstrong.

On April 13, I’ll be giving a seminar at Wharton in the Legal Studies and Business Ethics Speaker Series, in which I may present something related to these themes.

AALS Annual Meeting, January 4, 2015

 

The AALS Section on Business Associations is pleased to announce that it is sponsoring a Call for Papers for its program on Sunday, January 4^th at the AALS 2015 Annual Meeting in Washington, DC. 

The topic of the program and call for papers is “The Future of the Corporate Board.” 

How will boards adapt to recent changes and challenges in the business, legal, and social environment in which corporations operate?  The recent global financial crisis and the continuing need for many corporations to compete internationally mean that today’s boards face economic pressures that their predecessors did not.  This pressure is heightened by the rise of activist investors, many of whom aggressively push for changes to corporate management and governance. On the legal front, new regulations, such as Dodd-Frank, impose heightened compliance and other burdens on many companies and boards.  And on the social front, pressures for socially responsible corporate behavior and greater racial and gender diversity on boards continues.  Our program seeks to examine the ways in which boards have, and will in the future, respond to these challenges.    

Form and length of submission

Eligible law faculty are invited to submit manuscripts or abstracts that address any of the foregoing topics. Abstracts should be comprehensive enough to allow the review committee to meaningfully evaluate the aims and likely content of papers they propose. Papers may be accepted for publication but must not be published prior to the Annual Meeting.  Untenured faculty members are particularly encouraged to submit manuscripts or abstracts.  

The initial review of the papers will be blind.  Accordingly the author should submit a cover letter with the paper.  However, the paper itself, including the title page and footnotes must not contain any references identifying the author or the author’s school.  The submitting author is responsible for taking any steps necessary to redact self-identifying text or footnotes. 

Deadline and submission method

To be considered, papers must be submitted electronically to Kim Krawiec at [email protected].  The deadline for submission is SEPTEMBER 12, 2014. 

Papers will be selected after review by members of the section’s Executive Committee.  The authors of the selected papers will be notified by September 28, 2014. 

The Call for Paper participants will be responsible for paying their annual meeting registration fee and travel expenses.

Eligibility

Full-time faculty members of AALS member law schools are eligible to submit papers.  The following are ineligible to submit: foreign, visiting (without a full-time position at an AALS member law school) and adjunct faculty members, graduate students, fellows, non-law school faculty, and faculty at fee-paid non-member schools. Papers co-authored with a person ineligible to submit on their own may be submitted by the eligible co-author.

Second Annual Junior Faculty Scholarship Exchange

Dear Junior Scholar:

As the summer wanes and we move into the fall semester, the University of Massachusetts – Dartmouth School of Law wishes to invite you to our Second Annual Junior Faculty Scholarship Exchange. This is an opportunity for junior faculty in the New England region to gather together to discuss works in progress, finished papers, research interests, and to network with peers from other institutions. Our hope is to provide a local forum for legal scholars to develop their ideas and scholarship with input and constructive criticism from fellow law teachers. This event is especially aimed at faculty with seven, or fewer, years of law teaching experience.

Call for Abstracts: Harvard Law Petrie-Flom Center Conference on Law, Religion, and American Health Care

The Petrie-Flom Center for Health Law Policy, Biotechnology, and Bioethics at Harvard Law School is pleased to announce plans for our 2015 annual conference, this year entitled: “Law, Religion, and American Health Care,” to be held May 8-9, 2015.

Conference Description

Religion and medicine have historically gone hand in hand, but increasingly have come into conflict in the U.S. as health care has become both more secular and more heavily regulated. Law has a dual role here, simultaneously generating conflict between religion and health care, for example through new coverage mandates or legally permissible medical interventions that violate religious norms, while also acting as a tool for religious accommodation and protection of conscience.

This conference, and anticipated edited volume, will aim to: (1) identify the various ways in which law intersects with religion and health care in the United States; (2) understand the role of law in creating or mediating conflict between religion and health care; and (3) explore potential legal solutions to allow religion and health care to simultaneously flourish in a culturally diverse nation.

Twelfth Annual LatCrit-SALT Junior Faculty Development Workshop: Call for Participation

 I want to announce the "Call for Participation Twelfth Annual LatCrit-SALT Junior Faculty Development Workshop," which will be held at the University of Nevada-Las Vegas, Las Vegas, NV on October 9, 2014.  Cribbing now from the call:

LatCrit, Inc. and the Society of American Law Teachers (SALT) are pleased to invite interested participants to the Twelfth Annual Junior Faculty Development Workshop (FDW), immediately preceding the SALT Teaching Conference.  This annual workshop is designed for critical, progressive, and social justice oriented pre-tenure professors, including clinicians and legal writing professors, as well as those who may be contemplating a teaching career.  However, we also encourage more senior members of the profession to attend, share their experience, and serve as resources and mentors.

The FDW is designed to familiarize critical, progressive, and social justice oriented junior faculty with LatCrit and SALT principles and values and support them in the scholarship, teaching, and service aspects of professional success.  In addition, the FDW seeks to foster scholarship in progressive, social justice, and critical outsider jurisprudence, including LatCrit theory, among new and junior faculty, students, and practitioners.  Finally, the FDW aims to cultivate a community of scholars interested in the continuation of this and similar projects over the years.

To facilitate community building through shared experiences and the exchange of ideas, we strongly encourage all participants to attend the entire workshop.

Dear Friends and Colleagues,

We would like to invite you to a working-paper conference that we are planning to hold in the days before the AALS mid-year family law conference in Orlando next summer. Our group, the Family Law Scholars and Teachers Conference, has been known in the past as the Emerging Family Law Scholars and Teachers Conference (EFLS). That group held an annual conference for the past eight years, but until now has been limited to junior scholars. This year we are opening the conference to scholars at all levels of seniority, and are hoping that many of you can join us.

            The conference will take place on Monday, June 22, 2015, in Orlando, Florida—the day of the AALS workshop’s opening reception. Since our conference will be held earlier that day, these two events will not conflict. We will be hosted for the day by Florida A&M University College of Law, which is just a few minutes’ drive from the Doubletree Hotel that hosts the AALS workshop.

            For those of you who are not familiar with the EFLS conference, the main purpose of the meeting is to allow family law scholars to receive detailed, constructive feedback on their work in a supportive, collegial environment. In addition, the meeting is a forum to meet others in the field and talk about teaching, service, developments in the law, and other relevant themes raised by participants. Scholars present their work—either in its very initial form (an incubator session) or in its more developed form (a work-in-progress session)—in intimate groups. We have a very strong norm that participants carefully read drafts of the papers in advance of the sessions, and there are no formal presentations. Many of us feel that this has been a very meaningful conference that significantly contributed to our development as scholars and teachers.

            Although we have decided to open up the conference to scholars at all levels, we are still committed to preserving the conference’s intimate and supportive character. Therefore, we can accommodate only 45 participants, selected on a first-come-first-served basis. Additionally, although we will try to fulfill all requests for an incubator or work-in-progress session, if space is limited, we will give some preference to junior scholars. As always, there is no registration fee, and people only need to pay for their meals and accommodation. The Doubletree Hotel will give the discounted rate for rooms a couple of days prior to the conference.

            We will open up the registration and submission, via TWEN, in February 2015. For now, if you would like to receive announcements about the conference, please sign in on our TWEN page. Aspiring Law Professors Conference

There are fewer folks going on the AALS market this year, according to this data over at Prawfs, but there will always be aspiring law professors.  And for the sixth straight year, Arizona State is putting on an Aspiring Law Professors Conference.  It's September 27 in Tempe, and this year, Paul Caron will deliver the keynote.

We are seeking proposals for presentations and papers for the 2015 Workshop: Next Generation Issues of Sex, Gender and the Law, scheduled to take place June 24 - 26, 2015 at the Doubletree by Hilton at the Entrance to Universal Studios in Orlando, Florida.

After more than forty years of formal sex equality under the law, this 2015 workshop will ask legal academics to look ahead to the future and identify, name, and analyze the next generation of legal issues, challenges, and questions that advocates for substantive gender equality must be prepared to consider. To this end, we seek paper and presentation proposals that not only pinpoint and examine future law-related concerns about gender equality but that also provide innovative new approaches to achieving equality for women and those who challenge gender norms in our society, with a particular attention to employment, violence against women, reproductive rights, women's poverty, and women in legal education.

Our hope is to build on the insights of the participants in the 2011 AALS Workshop on Women Rethinking Equality by exploring new and forward-looking ideas for scholarship, law reform, and advocacy that can bring about women's equality. An additional expectation is that each session will address the ways in which characteristics other than gender, including race, sexual orientation, immigration status, socioeconomic class, and disability, impact women's lives. We also anticipate that each session will analyze the institutional strengths and weaknesses of courts, legislatures, and administrative bodies for bringing about change and offer suggestions for legal reforms that can better meet women's needs. Our final goal is to provide a rich and supportive atmosphere to foster mentoring and networking among teachers and scholars who are interested in women's equality and the law.

The format of the workshop will involve plenary sessions, concurrent sessions drawn from this Call for Presentations and Papers, and a closing panel. The closing panel, also drawn from this Call, will consist of a brainstorming session to consider projects and proposals for proactive measures to bring about gender equality.

Concurrent Sessions

The concurrent sessions will feature presentations related to gender equality issues, with preference given to presentations by junior scholars and those proposals related to the topics of employment, violence against women, reproductive rights, women's poverty, and women in legal education. We will organize the presentations into panels based on the subject matter of the proposals. Each presentation will last for 15 minutes, followed by questions from the moderator and audience.

Interested faculty should submit a brief written description (no more than 1000 words) of the proposed presentation, along with his or her resume. Please e-mail these materials to [email protected] by September 15, 2014. We will notify selected speakers by November 1, 2014.

Brainstorming Proposals

The final plenary session of the conference will consist of 10-12 five-minute presentations of ideas for future projects that will advance gender equality in the law. Each selected participant will be limited to five minutes to present his or her idea or project. The presentations will be followed by audience feedback and comments. Although we will grant preference to presentations by junior scholars and those proposals related to the topics of employment, violence against women, reproductive rights, women's poverty, and women in legal education for the concurrent sessions, we welcome proposals for this brainstorming session on any topic related to gender equality.

Interested faculty should submit a written description of the proposed presentation (no more than 1000 words), along with his or her resume. Please e-mail these materials to [email protected] by September 15, 2014. We will notify selected speakers by November 1, 2014.

Faculty members at AALS member schools are eligible to submit proposals.

Fellows at AALS member schools are eligible to submit proposals along with current curriculum vitae.

Visitors without faculty status at an AALS member law school and adjunct faculty members at AALS member schools are not eligible to submit proposals. Faculty at U.S. non-member law schools are not eligible to submit proposals. We do welcome your attendance at the workshop.

Shanghai: Work, Food, and More

I was in Shanghai last week for the first time, attending a conference and an alumni dinner. The conference – The 2014 International Forum on Financial Law — was at KoGuan Law School at Shanghai Jiao Tong University and was a lot of fun. The conference format was a new one for me and I thought worked very well, especially for an international audience.

The morning consisted of public lectures by party officials, regulators, practitioners, and academics with simultaneous translation. One or two of the Chinese academics were fairly critical of various aspects of the Chinese legal system, and watching the responses from fellow presenters and audience members was especially interesting, though I’m sure that I missed many of the subtleties of these exchanges.

The afternoon was divided into parallel sessions, one in Chinese and one in English, with paper presentations by invited guests. My presentation was in the English session, of course, so I can only speak to the specifics of that one, but I was very pleased with the quality of the presentations and discussion. I learned some new things about emerging corporate law and financial regulation issues in China, Singapore, and Japan, and was struck by both the similarities and the differences of the concerns: for example, several of the papers were on shadow banking in China, which is clearly a concern (as it is in the U.S.), but the character of shadow banking appears quite different in China, making the US experience only partially comparable.

My panel line-up was scheduled as follows, though for scheduling reasons there was a last minute switch of Shen Wei’s presentation on Chinese local government debt and shadow banking (which was excellent) instead of Cheng-Yun Tsang (who did a fine job on the next panel):

The AALS Section on Business Associations is pleased to announce that it is sponsoring a Call for Papers for its program on Sunday, January 4^th at the AALS 2015 Annual Meeting in Washington, DC. 

The topic of the program and call for papers is “The Future of the Corporate Board.” 

How will boards adapt to recent changes and challenges in the business, legal, and social environment in which corporations operate?  The recent global financial crisis and the continuing need for many corporations to compete internationally mean that today’s boards face economic pressures that their predecessors did not.  This pressure is heightened by the rise of activist investors, many of whom aggressively push for changes to corporate management and governance. On the legal front, new regulations, such as Dodd-Frank, impose heightened compliance and other burdens on many companies and boards.  And on the social front, pressures for socially responsible corporate behavior and greater racial and gender diversity on boards continues.  Our program seeks to examine the ways in which boards have, and will in the future, respond to these challenges.    

Form and length of submission

Eligible law faculty are invited to submit manuscripts or abstracts that address any of the foregoing topics. Abstracts should be comprehensive enough to allow the review committee to meaningfully evaluate the aims and likely content of papers they propose. Papers may be accepted for publication but must not be published prior to the Annual Meeting.  Untenured faculty members are particularly encouraged to submit manuscripts or abstracts.  

The initial review of the papers will be blind.  Accordingly the author should submit a cover letter with the paper.  However, the paper itself, including the title page and footnotes must not contain any references identifying the author or the author’s school.  The submitting author is responsible for taking any steps necessary to redact self-identifying text or footnotes. 

Deadline and submission method

To be considered, papers must be submitted electronically to Kim Krawiec at [email protected].  The deadline for submission is SEPTEMBER 12, 2014. 

Papers will be selected after review by members of the section’s Executive Committee.  The authors of the selected papers will be notified by September 28, 2014. 

The Call for Paper participants will be responsible for paying their annual meeting registration fee and travel expenses.

Eligibility

Full-time faculty members of AALS member law schools are eligible to submit papers.  The following are ineligible to submit: foreign, visiting (without a full-time position at an AALS member law school) and adjunct faculty members, graduate students, fellows, non-law school faculty, and faculty at fee-paid non-member schools. Papers co-authored with a person ineligible to submit on their own may be submitted by the eligible co-author.

Legal Scholarship We Like, and Why it Matters

University of Miami School of Law November 7-8, 2014

JOTWELL, the Journal of Things We Like (Lots), is an online journal dedicated to celebrating and sharing the best scholarship relating to the law. To celebrate Jotwell’s 5th Birthday, we invite you to join us for conversations about what makes legal scholarship great and why it matters.

In the United States, the role of scholarship is under assault in contemporary conversations about law schools; meanwhile in many other countries legal scholars are routinely pressed to value their work according to metrics or with reference to fixed conceptions of the role of legal scholarship. We hope this conference will serve as an answer to those challenges, both in content and by example.

We invite pithy abstracts of proposed contributions, relating to one or more of the conference themes. Each of these themes provides an occasion for the discussion (and, as appropriate, defense) of the scholarly enterprise in the modern law school–not for taking the importance of scholarship for granted, but showing, with specificity, as we hope Jotwell itself does, what good work looks like and why it matters.

I. Improving the Craft: Writing Legal Scholarship

We invite discussion relating to the writing of legal scholarship.

1. What makes great legal scholarship? Contributions on this theme could either address the issue at a general level, or anchor their discussion by an analysis of a single exemplary work of legal scholarship. We are open to discussions of both content and craft.

2. Inevitably, not all books and articles will be "great". What makes "good" legal scholarship? How do we achieve it?

II. Improving the Reach: Communicating and Sharing

Legal publishing is changing quickly, and the way that people both produce and consume legal scholarship seems likely to continue to evolve.

3. Who is (are) the audience(s) for legal scholarship?

4. How does legal scholarship find its audience(s)? Is there anything we as legal academics can or should do to help disseminate great and good scholarship? To what extent will the shift to online publication change how people edit, consume, and share scholarship, and how should we as authors and editors react?

III. Improving the World: Legal Scholarship and its Influence

Most broadly, we invite discussion of when and how legal scholarship matters.

5. What makes legal scholarship influential? Note that influence is not necessarily the same as "greatness". Also, influence has many possible meanings, encompassing influence within or outside the academy.

6. Finally, we invite personal essays about influence: what scholarship, legal or otherwise, has been most influential for you as a legal scholar? What if anything can we as future authors learn from this?

Mechanics:

Jotwell publishes short reviews of recent scholarship relevant to the law, and we usually require brevity and a very contemporary focus. For this event, however, contributions may range over the past, the present, or the future, and proposed contributions can be as short as five pages, or as long as thirty.

We invite the submission of abstracts for proposed papers fitting one or more of the topics above. Your abstract should lay out your central idea, and state the anticipated length of the finished product.
