CFP: Jaharis Health Law Symposium

The DePaul Journal of Health Care Law, Mary and Michael Jaharis Health Law Institute, and Center for Intellectual Property Law & Information Technology (CIPLIT®) are excited to announce a Call for Papers in connection with the 2022 Jaharis Health Law Symposium.

This year’s topic, “Antitrust and Access to Care: Lessons from Market Consolidation and a Public Health Crisis,” will explore how consolidation across health care markets has impacted access to care. Prominent legal scholars, antitrust enforcers and expert practitioners will address a range of questions through four separate panels focusing on health insurance, pharmaceutical, hospital and digital health markets.

Three papers will be selected from the submissions. Each selected author will receive a $500 honorarium and their article (of approximately 10,000 words) will be published in the Symposium issue of the DePaul Journal of Health Care Law. Full article drafts will be due by June 1, 2022.

We are open to a wide range of topics consistent with the Symposium theme but are particularly interested in papers from scholars with diverse experiences and backgrounds researching health insurance or pharmaceutical markets, as well as papers from junior scholars.

The Symposium will be held both in-person and remotely at DePaul College of Law in Chicago on March 10, 2022. Presenters able to appear in person will receive reimbursement for reasonable travel expenses.

Law, Space, and the Political CFP

The University of Wrocław in Poland is hosting a conference on "Law, Space, and the Political" on September 3 to 5, 2015.  The deadline for submissions of paper abstracts is June 30.  Cribbing now from their call for papers:

In September 2015, for the first time in its history, the Critical Legal Conference will symbolically cross the frontier of the former ‘Iron Curtain’ and take place in Poland, a country of the former Soviet bloc. This will happen quarter of a century following the region’s political and socio-economic transformation from ‘actually existing socialism’ to a mix of political democracy with neoliberally flavoured capitalism. CLC 2015 will be hosted by the University of Wrocław Faculty of Law, Administration and Economics in the region of Lower Silesia in south-western Poland.

For this year’s Critical Legal Conference – the first one ever to be held in Central and Eastern Europe – we invited stream organisers to reflect upon the complex relationship between law, space and the political, encouraging a broad understanding of those three notions. Looking from our Central European perspective, we have a special interest in the centre/peripheries dialectic, and the interrelationship between economic and political peripherality on the one hand, and various cultural transfers on the other, with particular reference to legal transfers (encompassing both specific legal institutions, as well as ‘units’ of legal culture, such as legal theories, concepts and doctrines). On the other hand, we invite reflections on the role of law in forging and upholding the centre/periphery dynamic, both in Europe and in the world.

Reposting: Conducting Empirical Legal Scholarship Workshop 2015

The 14^th annual workshop on Conducting Empirical Legal Scholarship, co-taught by Lee Epstein and Andrew D. Martin, will run from June 15-June 17 at Washington University in St. Louis. The workshop is for law school faculty, lawyers, political science faculty, and graduate students interested in learning about empirical research and how to evaluate empirical work. It provides the formal training necessary to design, conduct, and assess empirical studies, and to use statistical software (Stata) to analyze and manage data.

LegalEd's Igniting Law Teaching 2015 Conference

My colleague Michele Pistone is the founder of LegalEd, a nonprofit dedicated to using new ideas and technology to improve legal teaching. Its 2015 Igniting Law Teaching conference is this week. Registration is now open for LegalED’s Igniting Law Teaching 2015.  The conference is Friday, March 20, 2015 from 9:00 am – 5:00 pm EST at American University Washington College of Law.  It is also available for live viewing by webcast.

 The conference will feature talks by 30 law school academics and practitioners from the US, Canada and England in a TEDx-styled conference to share ideas on teaching methodologies.  LegalED’s Teaching Pedagogy video collection includes many of the talks from last year’s conference, which have been viewed collectively more than 5000 times.

 The panels for this year include: Law Teaching for the 21^st Century, Applying Learning Theory to Legal Education, The Art and Craft of Law Teaching, Using Technological Tools for Legal Education, and Pathways to Practice.  Here is a link to the topics, speakers and schedule.

 The Igniting Law Teaching conference is unlike other gatherings of law professors.  Here, talks will be styled as TEDx Talks, with each speaker on stage alone, giving a well scripted and performed 8 minute talk about an aspect of law school pedagogy.  In the end, we will create a collection of short videos on law school-related pedagogy that will inspire innovation and experimentation by law professors around the country, and the world, to bring more active learning and practical skills training into the law school curriculum.  The videos will be available for viewing by the larger academic community on LegalED, a website developed by a community of law professors interested in using online technologies to facilitate more active, problem-based learning in the classroom, in addition to better assessment and feedback.

American Society for Legal History 2015 Meeting CFP

I want to remind readers that the deadline for proposal for the 2015 American Society for Legal History (ASLH) annual meeting is fast approaching.  Cribbing from the CFP:

The 2015 annual meeting of the American Society for Legal History (ASLH) will take place in Washington, DC, October 29 – Nov 1, 2015. The Program Committee invites proposals on any facet or period of legal history, anywhere in the world. We also encourage thematic proposals that range across traditional chronological or geographical fields. In selecting presenters, preference will be given to those who did not present at the 2014 annual meeting.

Travel grants (covering airfare and ground transportation) will be available for presenters in need, who must first seek support from their home institution. These resources are limited, and priority will be given to presenters traveling from abroad, graduate students, post-docs, and independent scholars.

The Program Committee welcomes proposals for both full panels and individual papers, though please note that individual papers are less likely to be accepted. The Committee encourages the submission of a variety of different types of panel proposals, including: traditional 3-paper panels (with a separate chair-commentator); incomplete panels lacking either one paper or a chair-commentator (whether 2-paper panels with a chair-commentator, or 3-paper panels without a chair-commentator), which the Committee will try to complete; author-meets-reader panels; and roundtable discussions. ...

More details are available on the ASLH website.  On a personal note: I haven't been to ASLH in some years, in part because I've had family obligations and in part because the end of October/beginning of November is a hard time of year for me to get away from school.  But I hope to make it back this year.  I'm guessing I'll feel a little like Rip Van Winkle, given how many different directions legal history scholarship is moving.  At any rate, this is a great conference and I highly recommend it, especially for newer scholars.

Solicitation of Responses to Lessig at Cleveland-Marshall

Cleveland-Marshall College of Law and the Cleveland State Law Review will be hosting Professor Lawrence Lessig on April 17, 2015.  His address is “How Money (in politics) Matters.” The Cleveland State Law Review is building a symposium around the talk and is soliciting presenters to participate in the symposium.  More details are  here at the Cleveland State Law Review's call for presenters.  Their deadline for proposals is March 17.

Inequality and the Workplace: Stetson Law Review Symposium on March 6th.

On Friday, March 6^th, the Stetson Law Review will host a daylong symposium titled:  Inequality, Opportunity, and the Law of the Workplace.  The symposium will explore the relationship between growing economic inequality and the regulation of labor and employment in the United States.  What are the driving forces responsible for widening income or wealth inequality?  Should labor or employment laws be used to counteract income or wealth inequality?  What types of inequality can or should employment laws address?  Can labor or employment laws be effective in reducing inequality, given structural impediments such as globalization and the corporate form’s division of capital from labor?  Panelists will also explore some underappreciated practical and legal limitations on improving the economic mobility of low wage workers, including garnishment laws and the First Amendment’s impact on unionization. 

Wilma Liebman, former Chair of the National Labor Relations Board, is the keynote speaker.  Featured speakers include Timothy Noah, Politico’s Labor and Employment Editor and author of The Great Divergence: America’s Growing Inequality Crisis and What We Can Do About It, and CATO Institute Senior Fellow Michael Tanner.  David Cay Johnston (Syracuse), a Pulitzer-Prize winning journalist and the editor of Divided: The Perils of Our Growing Inequality, will serve as the moderator for a series of panels, which will including Samuel Bagenstos (University of Michigan), Matthew Bodie (Saint Louis University), Charlotte Garden (Seattle University), Dr. Larry Mishel (President, Economic Policy Institute), Paul Sonn (General Counsel/Program Director, National Employment Law Project), Katherine Stone (UCLA), Steven Willborn (Nebraska), and Michael Zimmer (Loyola-Chicago).  Written articles and essays will be published in the Stetson Law Review.

AALS Annual Meeting Panel Call for Papers: Perspectives on Privacy Law

The AALS Sections on Comparative Law, and on Defamation and Privacy will be sponsoring a joint program at the January 2016 Annual Meeting. The program will consider comparative perspectives on privacy law, particularly in light of recent developments in the European Union. The panel will comprise a combination of invited speakers, and speakers submitting proposals in response to this call for papers.

Paper proposals, works in progress, or completed papers are acceptable for submission. There is no formal requirement as to length of the proposal or final paper. Preference will be given to papers that offer novel scholarly insights on comparative aspects of privacy law. In particular proposals that share insights on comparative privacy practices outside the United States and the European Union will be welcomed. A paper may have already been accepted for publication as long as it will not be published prior to the Annual Meeting.

Proposals may focus on topics including, but not limited to, the following:

(a)  The interplay of law, norms, technology and market practices in protecting individual privacy.

(b)  Privacy interests in consumer and demographic information.

(c)   Privacy in relation to the protection of free speech.

(d)  Privacy rights given national security interests.

(e)  Health care and privacy.

(f)    Financial reporting and privacy.

(g)  Privacy in the context of law enforcement imperatives.

Police Violence in the Wake of Ferguson and Staten Island

UNC Law School is hosting a day-long program in the wake of Ferguson and Staten Island on Friday, January 23.  Cribbing now a little from their announcement:

A full-day program with three separate panels and a keynote speaker will provide a forum for discussion of police violence and the legal system, the history and context of police brutality, and activism in the face of police violence. Institutional Affiliations of AALS Annual Meeting Speakers

Trying to find the panel on which one of my colleagues was speaking, I discovered that one can use the AALS conference app to search de facto for speakers by institutional affiliation, instead of by name.  After thinking and writing yesterday about folks making multiple appearances on conference panels (see here), I wondered what schools provide the most speakers for the AALS Annual Meeting.  My guess was that results would vary based on geography, budgets and faculty culture. 

I searched the conference program for appearances by speakers affiliated with law schools in two groups: (a) the top 50 schools law schools identified by Brian Leiter in his study (here) of "Top 70 Law Faculties in Scholarly Impact, 2007-2011;" and (b) those schools that have joined the AALS since 1980 that do not appear in the top 50 on the Leiter list.  I could have done a search by all AALS member schools, but even my procrastination techniques have their limits!

By presenting this information, I do not mean to suggest the wisdom of ranking of schools by number of speakers supplied to the AALS Annual Meeting.  What I wonder, though, is whether the numbers suggest anything *other* than differences in school cultures -- i.e., that some faculties highly value AALS attendance and participation; others do not.  In terms of geography, I had assumed that D.C.-area schools would supply a disproportionate number of speakers, based on the conference location this year, but apart from Georgetown, GW and American, my assumption appears to be incorrect.  For those who think the current system for selecting speakers for AALS panels yields the "best" (however defined) speakers, does the school-based data add anything to the analysis? It may be that the results are purely descriptive.  For whatever it's worth, the AALS panels generally are not populated with more than one speaker per school (and there may be a rule prohibiting that; I don't know).

Should the AALS Limit Annual Meeting Apperances to One Per Person?

The AALS Annual Meeting is well under way in Washington, D.C.  For the first time, the conference had its very own app, which was handy in some ways, limiting in others.  After an initial glitch, the app became searchable by speaker name, which is convenient.  One of the interesting pieces of information that is more difficult to ascertain with the app than with the paper program is how many speakers are making repeat appearances on AALS programs.

The paper program lists 772 unique speakers.  Of these, 88 (or approximately 11.4%) are making more than one appearance -- whether as Moderator or Speaker -- at the conference.  Of the 88, 11 are making more than two appearances.

The last time I looked at similar data was 2011 (see prior post here). That year, there were 603 different speakers, 44 of whom (approximately 7.3%) were making more than one appearance.  12 of those 44 appeared more than twice. 

I would be in favor of a conference rule that limited participants to one speaking appearance, with an exception for award recipients and perhaps AALS Officers and Executive Committee members (hey, if Justice Ginsburg is willing to come to receive the Section on Women in Legal Education's Lifetime Achievement Award and to speak on a program, as she did this year, I wouldn't want a rule limiting that).  Short of a per se rule, I would favor a scheduling preference for programs that featured speakers not appearing on other programs.  When the AALS previously instituted a scheduling preference for programs that included a call for papers, that caused many sections to institute an open selection process for at least one of their speaking slots.  That was a salutary change and helped diversify the AALS Annual Meeting for more and different voices, but I think it is worth devoting continued attention to the issue.

Diversity and the Professions at AEA Tomorrow

Having just finished up the Business Associations program on The Future of the Corporate Board this morning, I’m now off to Boston for a panel tomorrow at the American Economics Association Annual Meeting.  If any other law profs happen to be wandering the halls, definitely stop in to say “hello.”  I’ll be discussing my research on board diversity, and whatever lessons it may hold for diversity in the professions.  Other panelists will discuss the single woman penalty and diversity and the innovation economy.  Fellow law prof Laura Beny (Michigan) is moderating and will also discuss diversity and law firms. 

Unfortunately, the timing of the two conferences was such that I’m only able to attend the last day of AEA.  That’s too bad, as there were a number of sessions that I really wanted to attend.  Ah well. Can’t be everywhere at once.

The State And The Market

I spent yesterday at a really fun roundtable on the State and the Market at Bar Ilan University. The roundtable, organized by Tsilly Dagan and me (well, really just Tsilly, who did all the work) featured several paper panels and discussion on issues that will interest Lounge readers interested in Taboo Trades.  Yuval Feldman presented an interesting paper (as always) about an MTurk study of subtle conflicts of interest – when “good people do bad things,” and Hila Shamir presented some early-stage research on how the state can support women in the workplace, in particular, working mothers.

I’m, of course, partial to my own panel, which featured Benny Shmueli’s paper on the alienability of the get (the Jewish divorce bill) and Ram Rivlin’s analysis of why we perceive certain transactions as taboo when the trading is among strangers, yet accept similar intra-familial transfers as uncontroversial.  I discussed commodification in the oocyte market – specifically, two cases of first impression in the United States (one an antitrust suit against the American Society For Reproductive Medicine and the other a tax case regarding the proper treatment of income earned from egg “donation.”) 

But the stars of the show were undoubtedly Tsilly Dagan and Talia Fisher, whose paper on the fragmentation and tradability of sovereignty makes even the proposal by my colleagues Joseph Blocher and Mitu Gulati (on the same panel) to marketize sovereign control look tame in comparison. 

It was also nice to see other Bar Ilan faculty in attendance, many of whom I met when I visited a few years ago, such as Shahar Lifshitz, Adi Ayal, and Jacob Nussim and, of course, to meet the new faculty who have been hired since I was there last.

The State and The Market

The intersection of the state and the market is the center of attention of many theoretical perspectives and disciplines.  The ways in which states design their markets and set their borders has a major effect on the nature of society, and the identities of individuals within it. At the same time markets (in goods, in services, investments as well as the market-like competition between states under globalization) alter states’ policies and capabilities and curtail their sovereign powers.

In this workshop, we wish to encourage participants to present their work in progress focusing on the description, explanation, and the normative evaluation of the mutual effects of states and markets: the cases where the two institutions limit one another and the cases where they facilitate each other’s prosperity.

Organs & Inducements

The latest issue of Law & Contemporary Problems is now out and you can access all of the articles in the volume online (see the embedded webpage below, or go here).  This issue, edited by Phil Cook and me, features articles from law, medicine, economics, and more.  Each paper addresses the ethics, laws, and other issues relating to inducements for organ donation.  I'll be back with more to say about specific papers in the volume, but in the meantime, there are very few other sources that tackle this question so specifically or in such depth.  Prior posts on the Organs & Inducements symposium are here and here.

Risk Regulation Slides Are Posted

As I mentioned in an earlier post, the OECD Regulatory Policy Division, together with the International Risk Governance Council (IRGC) and the Rethinking Regulation program at Duke University recently held a conference on Improving Risk Regulation: From Crisis Response To Learning and Innovation at the OECD Conference Centre in Paris.  All of the slides from the conference, including mine, have now been posted online, and some of you may find some of the presentations useful. 

From the IRCG conference website:

New approaches to regulation may be stimulated by careful research and practical experience, but also spurred by crisis events that alter perceptions and spark demand for policy change.  What can we learn from these diverse sources of regulatory change? How can we do a better job in fostering constructive regulatory improvement?

The conference identified, evaluated and discussed the relevance and effectiveness of new approaches to improving risk governance, both as they result from responding to and learning from crises, and as deliberate innovations in how regulatory power is exercised and shared.  It built upon: 

• Work from the OECD Regulatory Policy Division about “Risk and Regulatory Policy – Improving the Governance of Risk” and recommendation about performance- and consumer-based regulation
• The project on “Recalibrating Risk: Crises, Perceptions and Regulatory Change,” of the Rethinking Regulation program at Duke University, which investigates how regulatory policies and institutions change in response to crisis events, and seeks lessons for the future
• IRGC’s work on the role of regulatory frameworks and institutional arrangements in the context of risk governance, including mechanisms for adaptive regulation that are able to update in response to new information and contexts.

The conference brought together practitioners of risk governance and regulation from private, public and academic organizations interested in sharing knowledge and enhancing their understanding of crisis and new forms of risk regulation.
