UCF Legal Studies Seeks Visiting Lecturers

UCF’s Department of Legal Studies seeks applications for multiple one-year Visiting Lecturer positions to begin on or about August 8, 2023. We are looking for collegial candidates with strong academic backgrounds, a commitment to innovative instruction, and a demonstrated record or potential to offer premier law-centered research, teaching, and service to students and the community. Current hiring needs exist in a variety of areas, including core class such as law and the legal system (i.e., a foundational course offering a broad understanding of basic principles of the law as well as the role and function of the legal system); civil practice and procedure; criminal law; evidence; professionalism; and trial advocacy. The successful candidate will teach the equivalent of four courses per semester (both face-to-face and by web-delivery). We also are especially interested in identifying candidates keen to innovate our curriculum with courses that connect with the broad STEM-based competencies of the university as well as other areas of importance to our local, state, and national community, including law and technology, health care, hospitality management, and sports and entertainment.

The Department of Legal Studies is situated in the College of Community Innovation and Education and the primary assignment will be located at our Downtown Campus. UCF Downtown brings more than 7,000 students to live, learn and work in downtown Orlando. Opened in August 2019, UCF Downtown is a 15-acre campus located in Orlando’s Creative Village. Made up of several buildings, the new campus incorporates innovative technology to create a 21st-century learning environment that places students within walking distance of job and internship opportunities, and makes it easy for faculty to invite guest speakers to campus or collaborate with professionals in their field of study.

 

Submission Guide for Law Review Online Companions

Submission season is upon us.  Inspired by Allan Rostron and Nancy Levit's most recent update to their useful law review submission guide (here), I've updated my copycat guide to submitting shorter piece to the online companions at 20 top journals.

Some take-aways:

(1) More of the online journals are gravitating toward Scholastica for submissions (and from what I can tell, the big beneficiary of that move is that company's owners).

(2) Wash U Law Review Online is the only companion journal not yet included in the HeinOnline Law Journal Library, but expect that to change in the future.

(3) The length of pieces that online journals accept varies widely.

University of Mississippi Law Seeks Tenure-Track Faculty

The University of Mississippi School of Law invites applications from entry-level and lateral candidates for multiple tenure-track faculty positions beginning August 2023. New Mexico Law Seeks Tenure/Tenure-Track Legal Analysis Faculty

The University of New Mexico School of Law invites applications for one or two full-time, tenured or tenure-track faculty position to teach in its Legal Analysis and Communication Program, starting in the Fall of 2023.

Faculty in the Program are responsible for teaching Elements of Legal Argumentation (ELA) I & II, the Law School’s required first-year legal writing sequence. ELA I & II focus on developing students’ skills in legal research, analysis, and communication. The Program’s faculty typically teach two first-year sections of 15-20 students each (or 30-40 students total). The Program’s faculty also teach upper-level writing courses, and the successful candidate will be expected to help design and implement the Program’s upper-level writing curriculum. Faculty in the Program serve on all Law School committees (including serving as chairs of committees), and are eligible for summer research and teaching grants. The Legal Analysis and Communication Program is a director-led program that values close collaboration and quality teaching.

Alabama School of Law Seeks Tenure/Tenure-Track Faculty

Call for Help: Borrower Defense to Repayment at For-Profit Law Schools

As some of you may have heard or read, a preliminary settlement in the case of Sweet v. Cardona has created the possibility that many former students of predatory for-profit colleges and Universities will receive loan forgiveness from the Department of Education.  The list of schools for which former students may be eligible for relief includes four for-profit law schools: the three former InfiLaw schools (Florida Coastal School of Law, Charlotte School of Law and Arizona Summit Law School), all of which are now closed, and Western State University College of Law, which has changed ownership and is now Western State College of Law at Westcliff University.  (See list of other eligible schools here.)   (Full disclosure - I taught at Western State from 2005-2010. This is well before the period when Western State was alleged to have defrauded any students, and I am not aware of any malfeasance that occurred while I was there.)

 The Plaintiffs in the case had sued the Department of Education for failing to process or unfairly denying their borrower defense to repayment applications.  Under the settlement, students at these schools who were part of the class action will receive full relief from their federal loan indebtedness.  The settlement also allows borrowers who were not part of the class to file a borrower defense application seeking relief.  I am working with a group of Florida Coastal alumni and former students who are trying to get the word out to other alumni and former students (including those who did not graduate) about this program and encourage them to apply while they still can get favorable consideration (before the final settlement is approved by the Court).  Former students who took out federal loans to attend can apply for full or partial discharge of their loans and may also be eligible for refunds of amounts paid and credit repair services.  For those borrowers who are not already part of the class, their applications must explain how they were financially harmed by the school due to misrepresentations by the school.    These misrepresentations could relate to employment rates or prospects and earnings potential, institutional selectivity rates or rankings and admissions information, availability about or nature of financial assistance available, availability of educational resources, bar passage rates, or any other false, misleading or deceptive information that induced a student to enroll or stay at a school.

So where do The Faculty Lounge readers come in?  First, please help spread the word to potential beneficiaries of this program and encourage them to apply.  They have nothing to lose.  Apply here. Second, if you are a former faculty member or employee of any of these schools, or are otherwise personally aware of any misrepresentations, or fraudulent or deceptive practices engaged in by these schools, now would be the perfect time to come forward and share what you know, and potentially help students with mountains of debt.  The applicants may believe that they have been misled or deceived, but it is difficult to prove without direct evidence or independent corroboration.  There have been many efforts to sue InfiLaw Schools under various theories of fraud, but InfiLaw has been very successful at fending off these lawsuits before they ever got to the discovery stage, so there is very little hard evidence in the public domain that the applicants can use to bolster their applications.

As regular listeners know, I’ve sadly had to say goodbye to the amazing group of students who were my co-hosts for Season 2. But I decided to do a couple of bonus episodes this summer, and this is the first, featuring Sean Williams of the University of Texas School of Law. I also have a very special co-host, one of my favorite colleagues at UVA Law, Gregg Strauss.

Sean Williams studies decision making dynamics in a wide variety of areas including marriage markets, parental investments in child safety, jury damage awards, and consumer contracts. He writes widely on Family Law, Tort Theory, and Behavioral Law and Economics. Remembering Michael Olivas and Our Tasks Ahead 

Over fifty of the country's leading scholars and law deans are gathering via Zoom this Thursday and Friday s to honor Professor Michael Olivas and to pass the baton to new leaders in our profession. In addition to saluting the creator of the Dirty Dozen List and the Dean of all Latina and Latino Law Professors, we will have a dozen young scholars, members of the Olivas Faculty Recruitment Initiative, presenting their works in progress. 

Moreover, I would argue the FIU COL and the Houston Law Center has gathered the greatest collection of scholars since the creation of  CRT at the University of Wisconsin in 1988. The leading lights presenting include, LSAC President Kellye Testy, Seattle's Richard Delgado and Jean Stefancic, Yale's Gerald Torres, UC Davis's Jack Chin, UC Irvine's Rachell Moran, UC Davis's Kevin Johnson, Houston's Sandra Thompson, UF's Bert Hernandez, Penn St.'s Shoba Wadhia, Loyola's Juan Perea, and a host of others. 

I hope you will join us, and if you know of any aspiring law professors of any background, have them reach out to me. I may add them to the event, and will unquestionably work with them as part of the Olivas Faculty Recruitment Initiative. Freakonomics, M.D. on ME/CFS and Long Covid

Excellent podcast by Dr. Bapu Jena, M.D., PhD. on ME/CFS and Long Covid. Dr. Jena is a physician and an economist, so he is especially well suited to explore the medical and funding issues regarding ME/CFS. 

It is fairly long (30 minutes) but definitely worth listening for those who are interested, here.

Lewis & Clark Law Seeks Faculty
