I wanted to share my review, just published in Jotwell: Equality, of Bethany Berger's excellent piece, Savage Equalities, on the varied meanings of equality in the context of Federal Indian Law and how best to evaluate equality claims relating to tribes and tribal rights. This article is a must-read for those who teach or write in the field as well as for those who teach or write on Civil Rights and Race & the Law and want to think more about how tribes and Native individuals fit in.
In its more general meaning, "equity" is not a word I associate with federal Indian law.
