In the context this sounds really strange to me, and you'd know better than I, but could it be that they obtained a common law writ of replevin, treating the person as a good ?

Really interesting question, Greg. Alabama had a statute that provided for kidnapping victims (abd others claiming they were wrongfully enslaved) to file suit.
