The South Carolina Attorney General's office has issued an advisory opinion regarding scope of issues properly considered by the state's Commission on Higher Education when evaluating InfiLaw's proposal to buy the for-profit Charleston Law School. The upshot seems to be that the AG won't be supporting the Commission if it relies on the criteria used by the Commission's panel when it recommended against approving the merger. Because approval of the purchase is apparently a "ministerial function", the Commission's grounds for review are highly constrained.
