For those without premium access to NLJ.com have asked to see Karen Sloan's article on the ABa, Diversity and 301-6. First, it's odd in that I can see the article, even though I do not have premium access. And I cannot access much of the NLJ.com content, except the Law Schools stuff. As I said, odd.
I problems with ripping--taking a substantial part of the text of an article, a blog-post, or even an SSRN abstract that is on another site. It stretches fair use, and it doesn't feel "right." But, as I tell my students, I'm naturally cautious, and tend to think in terms of belts, suspenders and staples.
Which means that I tend to quote only one or two small extracts--just enough to give readers a sense of the piece. That said, my extracts from Sloan's article were very brief. More later
