This is an area where we can take a page out of the medical profession's book, though usually the reverse is true. While not a good idea to get up and walk out of court during trial, come on, it is not life or death. In most jurisdictions, the medical board will allow doctors a pretty long rope to 'get their sh-- together". It seems most medical doctor issues involve drug use or abuse, depending on your perspective. When the doctors' stress level becomes too much to bear and they start sampling the product, they are all pretty much given a free pass on the first offense and given some help. In the legal profession, we don't so much recognize that our stress level can be so great as to cause all sort of nonsense (e.g. mental meltdown, excessive anger, sex abuse, domestic abuse, drugs, alcohol, crime, breaking the rules). In fact, it seems more likely than not that an attorney will be 'put out to pasture' when they encounter their first serious problem. I think it should be more common that we assist the attorney to regain the capabilities they once had. But, to be perfectly honest, I think the rest of the bar is usually happy to get rid of the competition. Who's making the profession look bad now?
