Thanks to Euguene Volokh, we now learn that the Minnesota teen arrested on misdemeanor counts of flag desecration will not be prosecuted. Good news, to a point. The conduct may be constitutionally protected, but one thing is for sure (at
least in the view of the police chief): it won't be tolerated.
[Police Chief] Pomeroy said his department referred the teen to the county attorney's office because something had to be done about the behavior, but it's ultimately up to the attorneys to prosecute.
I'll stick by my prior comments:
The Supreme Court can say whatever it wants. Local officials know better.
