This amusing little story fluttered into my inbox (via my Pacific colleague Jerry Caplan). Apparently a man in India sued the makers of Axe Body spray for breach of contract, alleging that he used the product on a regular basis but that the product failed to deliver. The commercials for Axe feature women flinging themselves at men. The man in question, however, claimed that seven years have gone by and he still has no girlfriend.
After a little searching around on the internet, however, turns out that several websites have called foul. And not because of the odor. This report states that Unilever (Axe’s manufacturer) is not being sued at all; the story began on a joke news reporting website and then went viral.
Regardless of its truth, it still makes for a fun contracts hypothetical.
No need for the hypo when you have the Leonard v. Pepsico reality.
